Yesterday, certiorari was denied from an Eleventh Circuit decision that upheld the constitutionality of a Florida statute prohibiting adoptions by homosexuals. Lofton v. Secretary, Florida Dept. of Children and Families, 358 F.3d 804 (C.A.11- Fla. 2004). The 11th Circuit found that applying a rational basis standard of review was rationally related to a legitimate state interest in furthering the best interests of adopted children by placing them in families with married mothers and fathers.
I'm rather surprised the Court denied cert, especially in light of its decisions in Lawrence and Romer.
